MONTANA'S NEW GUN LAW, 2ND AMENDMENT "INCORPORATION," AND GUN REGISTRATION

        Recent firearms-related activity could affect Arizona gun owners. A few weeks ago, Entry #1 in our Articles & Letters Section described a new Montana law that declares guns made and retained in Montana are exempt from federal regulation. The law is called the Montana Firearms Freedom Act (MFFA). Recently, the Montana Shooting Sports Association and the Second Amendment Foundation joined forces to test the law in court. They will file suit for a declaratory judgment in federal court when the law goes into effect on October 1st. Simply stated, this means that a court will decide if the law is valid before anyone claims harm from its application. This is heady stuff for Arizona gun owners. Imagine Ruger's Prescott manufacturing facility making guns that (if kept in the state) are immune from federal control.

        In the last few weeks, there's been activity in two additional areas that affect gun owners. Two important gun-related issues are working their way through the United States court system. The issues are: incorporation of the 2nd Amendment into state law and the legality of firearms registration. An overview of recent events in both these areas is presented as Entry #3 in the Articles & Letters Section. Citizens need to track these important issues.
